Each
item in this exhibition will be auctioned and sold
to the highest bidder. The items will be displayed
upon arrival and time will be provided for each
guest to view the item closely.

The
terms for the purchase of an item offered in this
exhibition will be cash, check, cashier's check or
credit card (VISA, MasterCard, or American
Express). All monies shall be made payable to
Texas Art Gallery.

Credit
cards will not be accepted for payment over
$10,000.

The
purchaser will be required to pay local and state
sales tax. Deliveries outside the state may be
subject to the compensating use tax of another
state and where a duty of collection is imposed
upon them by law. The gallery will require payment
by the purchaser of such taxes.

If
the foregoing conditions or any other applicable
conditions herein are not complied with, including
the right of the gallery to hold purchaser liable
for the price of the property stated on the signed
confirmation card, the gallery, at its option, may
either (a) cancel the sale, retain as liquidated
damages all payments made by the purchaser; or (b)
resell the property on three (3) days notice to
the purchaser and for the payment of any
deficiency plus all costs, including warehousing,
the expense of both sales, and the Gallery's
commission at its regular rates and all other
charges due hereunder and incidental damages.

The
copyrights for each piece of art in this
exhibition are reserved by the artist. All text in
the catalog, and on this website, is copyrighted
and cannot be reproduced without the specific
permission of Texas Art Gallery.

Some
items of property may be offered to a
"reserve" or confidential minimum price,
below which the item will not be sold. In such
instances, the Gallery may implement the reserve
by bidding on behalf of the Consignor.

Any
and all disputes during the auction will be
settled by the Auctioneers: William E. Burford,
State License #TX6084 or Phil Stoll, State License
#TXL11543.

The
purchase price payable by a buyer shall be the sum
of the final bid and a premium of 15% on the first
$100,000 bid and 10% thereafter.

All
property will be sold as is, and neither the
Gallery, nor Consignor, nor Auctioneer make any
express or implied warranties or representations
with respect to the property or correctness of the
advertisement, catalogue and other medium used to
announce this auction or any other description of
the physical condition, importance, quality, size
or authenticity of the property offered.

The Gallery offers write-in and telephone bid
service for those unable to attend the auction.

Telephone and write-in bids will
be accepted until 8pm on the
Friday preceding the auction on
Saturday.

Lots will be purchased as cheaply as bidding
allows. The Gallery will not be held responsible
for errors or failure to execute such bids.
Successful bidders will be notified and invoiced
within a few days.

Payment
in full before or on delivery. Unsuccessful
bidders will not be specifically notified.

Shipment
of any lots will be at purchaser's expense.
